City of Hagerstown Participant Release, Waiver, Assumption of Risk, and Indemnification & Hold Harmless Agreement
In consideration for being permitted to participate in the activities described herein, I, (“the Participant”), for myself, my child(ren), my heirs, successors, executors, administrators, and assigns, do hereby fully and forever release, discharge, covenant not to sue, and agree to indemnify and hold harmless the City of Hagerstown, Maryland, the Alsatia Club, Inc., and each of their respective officers, directors, agents, employees, volunteers, servants, and insurers from and against any and all claims, demands, actions, causes of action, liabilities, losses, costs, damages, or expenses of any kind or nature whatsoever, whether in law or equity, whether known or unknown, foreseen or unforeseen, arising directly or indirectly out of or in connection with my participation, or the participation of any individuals (including, but not limited to, minors) associated with this entry, in the Alsatia Mummers’ Parade held in the City of Hagerstown, Maryland.
The Participant further represents and warrants that they fully understand participation in this activity involves inherent risks, including, but not limited to, the risk of injury to persons and damage to property. The Participant agrees to provide notice of this waiver of liability to all individuals participating in this entry, including, where applicable, the parent(s) or legal guardian(s) of any minors. The Participant affirms that they are in good physical and mental condition and voluntarily accept and assume all such risks, whether foreseen or unforeseen, associated with participation in the above-referenced activity.
